The Reposter is provided by Market Sourcing Solutions Pty Ltd (ACN 672 365 990), 99 Bridgewater-maldon Rd 3463 (“Company,” “we,” “us” or “our”).<\/p>\n \n <p>By installing, accessing, or using the Reposter, you agree to be bound by this EULA and our Privacy Policy. If you do not agree, do not use the Reposter.<\/p>\n <\/div>\n\n <div class=\"relationship-note\">\n <p><strong>Relationship to other terms.<\/strong> To the extent our website Terms and Conditions contain prohibitions on automated use, those prohibitions do not apply to your use of the Reposter to the extent expressly permitted by this EULA. If there is a conflict between this EULA and the website Terms and Conditions in relation to your use of the Reposter, this EULA controls.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>1. Definitions<\/h2>\n <table class=\"definitions-table\">\n <tr>\n <th>App Distributor<\/th>\n <td>means any platform distributing the Reposter or enabling purchase or installation (e.g., Chrome Web Store, Microsoft Edge Add-ons, Apple App Store, Google Play).<\/td>\n <\/tr>\n <tr>\n <th>Automations<\/th>\n <td>means any automated actions the Reposter performs, including posting, re-posting, form-filling, scheduling, rate-limited retries, and template insertion.<\/td>\n <\/tr>\n <tr>\n <th>Device<\/th>\n <td>means any device on which you install or use the Reposter.<\/td>\n <\/tr>\n <tr>\n <th>Third-Party Platform(s)<\/th>\n <td>means online marketplaces and services (e.g., Facebook Marketplace, Craigslist, OfferUp, etc.) to which the Reposter can post or from which it can interact with content.<\/td>\n <\/tr>\n <tr>\n <th>Kullan?c? ?\u00e7eri?i<\/th>\n <td>means content you submit, upload, or instruct the Reposter to post (including text, images, videos, data, templates, and metadata).<\/td>\n <\/tr>\n <tr>\n <th>Credentials<\/th>\n <td>means your logins, session tokens, cookies, two-factor methods, or similar authentication artifacts for Third-Party Platforms.<\/td>\n <\/tr>\n <\/table>\n <\/div>\n\n <div class=\"section\">\n <h2>2. Licence Grant and Scope<\/h2>\n <h3>2.1 Grant.<\/h3>\n <p>Subject to your compliance with this EULA and, if applicable, payment of all fees, we grant you a limited, revocable, non-exclusive, non-transferable licence to install and use the Reposter on your Device(s) for your internal business or personal use.<\/p>\n \n <h3>2.2 Territory & Term.<\/h3>\n <p>The licence is worldwide and continues until terminated under Section 13.<\/p>\n \n <h3>2.3 Reservation.<\/h3>\n <p>We reserve all rights not expressly granted.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>3. Your Responsibilities<\/h2>\n <h3>3.1 Platform Compliance and Authorisation.<\/h3>\n <p>You are solely responsible for ensuring that your use of the Reposter complies with all laws and with all terms, policies, and rules of each Third-Party Platform you use. We are not affiliated with or endorsed by any Third-Party Platform. You expressly authorise the Company to perform automated actions via your logged-in sessions on Third-Party Platforms, including but not limited to Facebook, Craigslist, to the extent configured by you within the Reposter. You grant the Company all rights necessary to execute such automated actions solely for the purpose of delivering the Reposter’s functionality.<\/p>\n \n <h3>3.2 User Content Rights.<\/h3>\n <p>You represent and warrant that you own or have all necessary rights to User Content and the authority to post it via the Reposter, and that your postings will not infringe any third-party rights, violate laws, or breach platform rules.<\/p>\n \n <h3>3.3 No Unlawful or Abusive Use.<\/h3>\n <p>You must not use the Reposter for unlawful conduct, spam, scams, harassment, abusive behaviour, or to circumvent platform access controls in ways prohibited by applicable law.<\/p>\n \n <h3>3.4 Rate Limits, CAPTCHAs & Changes.<\/h3>\n <p>Third-Party Platforms may rate limit, throttle, deploy CAPTCHAs, or change their interfaces; the Reposter may fail or behave differently as a result. You understand and accept these risks.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>4. Automated Interactions<\/h2>\n <h3>4.1 Authorised Automation.<\/h3>\n <p>The Reposter performs Automations that you configure. To the maximum extent permitted by law and platform terms, you authorise those Automations on your behalf.<\/p>\n \n <h3>4.2 Human-in-the-Loop.<\/h3>\n <p>You remain responsible for reviewing any drafts or postings before they are sent where the Reposter offers that option.<\/p>\n \n <h3>4.3 Fair Use & Load.<\/h3>\n <p>You agree to configure reasonable schedules and volumes. You must not overload or attempt to degrade a Third-Party Platform.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>5. Credentials & Security<\/h2>\n <h3>5.1 Your Accounts.<\/h3>\n <p>The Reposter interacts with your authenticated browser sessions. By default, we do not require you to provide Third-Party Platform passwords directly to us. If you elect to store or transmit Credentials to us or our services, you authorise us to process them solely to operate the Reposter and as described in our Privacy Policy.<\/p>\n \n <h3>5.2 Safeguards.<\/h3>\n <p>You are solely responsible for safeguarding your Devices, browsers, network, and Credentials (including enabling 2FA where available), and for all activities under your accounts. We are not responsible for any unauthorised access to or compromise of your Third-Party Platform accounts (including, without limitation, Facebook Marketplace accounts), regardless of how such access occurs, and you bear sole responsibility for securing your accounts and login information.<\/p>\n \n <h3>5.3 Security Events.<\/h3>\n <p>You must promptly notify us of any suspected unauthorised access to the Reposter or your accounts. We may require you to implement additional security steps or suspend Automations pending investigation.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>6. Service Changes; No Guarantee of Posting<\/h2>\n <h3>6.1 No Guarantee.<\/h3>\n <p>We do not guarantee that any post, re-post, or other action will be completed, delivered, or remain available. Third-Party Platforms can block, remove, shadowban, throttle, or otherwise interfere with your posts or accounts at any time.<\/p>\n \n <h3>6.2 Updates.<\/h3>\n <p>We may modify, suspend, or discontinue features without notice where required by law, by App Distributors, or due to changes on Third-Party Platforms.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>7. Fees & Trials<\/h2>\n <h3>7.1 Billing.<\/h3>\n <p>If the Reposter is offered on a subscription basis, fees, renewals, and cancellation terms are as stated at the point of purchase or in your account dashboard.<\/p>\n \n <h3>7.2 No Refunds.<\/h3>\n <p>Except where required by law, fees are non-refundable once the billing period begins.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>8. Intellectual Property<\/h2>\n <h3>8.1 Our IP.<\/h3>\n <p>The Reposter, its code, design, and all related IP are owned by us or our licensors.<\/p>\n \n <h3>8.2 Restrictions.<\/h3>\n <p>You must not (except where prohibited restrictions are unenforceable by law): (a) reverse engineer, decompile, or disassemble the Reposter; (b) copy or distribute it; (c) remove proprietary notices; (d) use it to build a competing product; or (e) use any non-public interfaces.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>9. Prohibited Uses (Reposter-Specific)<\/h2>\n <p>You must not use the Reposter to:<\/p>\n <ul>\n <li>engage in illegal scraping where prohibited by law;<\/li>\n <li>send unsolicited or deceptive communications;<\/li>\n <li>deceive, impersonate, or misrepresent identity;<\/li>\n <li>upload malware or attempt to bypass security measures; or<\/li>\n <li>interfere with or degrade Third-Party Platforms.<\/li>\n <\/ul>\n <\/div>\n\n <div class=\"section\">\n <h2>10. Disclaimers<\/h2>\n <h3>10.1 “AS IS”.<\/h3>\n <p>To the maximum extent permitted by law, the Reposter is provided “AS IS” and “AS AVAILABLE” without warranties of any kind (including fitness for a particular purpose, non-infringement, error-free or uninterrupted operation, or data security).<\/p>\n \n <h3>10.2 No Third-Party Liability; Waiver.<\/h3>\n <p>We are not responsible for the acts or omissions of Third-Party Platforms, including account suspensions, removals, shadow-bans, throttling, outages, or policy changes, and you irrevocably waive and release any claims, demands, or causes of action against us arising from or related to such platform actions.<\/p>\n \n <h3>10.3 Australian Consumer Law.<\/h3>\n <p>Nothing in this EULA limits your non-excludable rights under the Australian Consumer Law.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>11. Limitation of Liability<\/h2>\n <h3>11.1 Cap.<\/h3>\n <p>To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Reposter will not exceed:<\/p>\n <ul>\n <li>(a) if you are a paid user, the total amount you have paid to us for the Reposter in the 12 months preceding the event giving rise to liability; or<\/li>\n <li>(b) if you are a free user (including trial users), AUD $0.<\/li>\n <\/ul>\n \n <h3>11.2 Excluded Damages.<\/h3>\n <p>To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data; cost of substitute goods\/services; or business interruption, even if foreseeable.<\/p>\n \n <h3>11.3 Carve-outs.<\/h3>\n <p>The above limitations do not apply to liability that cannot be excluded by law (e.g., death or personal injury caused by negligence).<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>12. Indemnification (User Obligations)<\/h2>\n <p>You will defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:<\/p>\n <ul>\n <li>(a) your User Content or your use of the Reposter;<\/li>\n <li>(b) your breach of this EULA or violation of any law;<\/li>\n <li>(c) your use of Third-Party Platforms, including any alleged or actual non-compliance with their terms, policies, or community standards;<\/li>\n <li>(d) any account action taken by a Third-Party Platform against you (including warnings, limits, suspensions, blocks, or permanent bans), and any consequential loss or damages you suffer as a result;<\/li>\n <li>(e) any security breach of your Device(s), network, browser, or Third-Party Platform account(s), including compromises arising from your storage, transmission, or failure to safeguard Credentials, or from malware or misconfiguration in your environment; and<\/li>\n <li>(f) any claim that your use of the Reposter infringes or misappropriates third-party rights when based on your configuration, prompts, schedules, logged-in automation sessions, or User Content.<\/li>\n <\/ul>\n <p>Your indemnity applies to the maximum extent permitted by law and does not require a prior finding of fault by us. We may assume control of the defence at our expense; you will cooperate fully.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>13. Suspension & Termination<\/h2>\n <p>We may suspend or terminate your access to the Reposter immediately (with or without notice) if you breach this EULA, if required by law or by an App Distributor, or if continued operation would pose risk. Upon termination, you must stop using and uninstall the Reposter. Sections intended to survive (including 3\u20135, 6.1, 8\u201312, 15\u201316) will survive.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>14. Distributor Terms & Third-Party Beneficiaries<\/h2>\n <p>Where applicable, your use of the Reposter is also subject to the terms of the relevant App Distributor (e.g., Chrome Web Store, Apple, Google). Those distributors are third-party beneficiaries of this EULA with the right to enforce applicable provisions.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>15. Export, Sanctions & Compliance<\/h2>\n <p>You represent that you are not located in, under the control of, or a national or resident of any country or person on any applicable sanctions list. You will comply with all export control and sanctions laws applicable to your use of the Reposter.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>16. Governing Law; Venue<\/h2>\n <p>This EULA is governed by the laws of the State of Victoria, Australia, without regard to conflict of laws rules. You submit to the exclusive jurisdiction and venue of the courts located in Victoria, Australia. Nothing limits mandatory protections under applicable consumer law.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>17. Changes<\/h2>\n <p>We may update this EULA from time to time. Material changes will be notified via the Reposter, our site, or email. The Reposter is provided by Market Sourcing Solutions Pty Ltd (ACN 672 365 990), 99 Bridgewater-maldon Rd 3463 (“Company,” “we,” “us” or “our”).<\/p>\n \n <p>By installing, accessing, or using the Reposter, you agree to be bound by this EULA and our Privacy Policy. If you do not agree, do not use the Reposter.<\/p>\n <\/div>\n\n <div class=\"relationship-note\">\n <p><strong>Relationship to other terms.<\/strong> To the extent our website Terms and Conditions contain prohibitions on automated use, those prohibitions do not apply to your use of the Reposter to the extent expressly permitted by this EULA. If there is a conflict between this EULA and the website Terms and Conditions in relation to your use of the Reposter, this EULA controls.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>1. Licence Grant and Scope<\/h2>\n <h3>2.1 Grant.<\/h3>\n <p>Subject to your compliance with this EULA and, if applicable, payment of all fees, we grant you a limited, revocable, non-exclusive, non-transferable licence to install and use the Reposter on your Device(s) for your internal business or personal use.<\/p>\n \n <h3>2.2 Territory & Term.<\/h3>\n <p>The licence is worldwide and continues until terminated under Section 13.<\/p>\n \n <h3>2.3 Reservation.<\/h3>\n <p>We reserve all rights not expressly granted.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>3. Your Responsibilities<\/h2>\n <h3>3.1 Platform Compliance and Authorisation.<\/h3>\n <p>You are solely responsible for ensuring that your use of the Reposter complies with all laws and with all terms, policies, and rules of each Third-Party Platform you use. We are not affiliated with or endorsed by any Third-Party Platform. You expressly authorise the Company to perform automated actions via your logged-in sessions on Third-Party Platforms, including but not limited to Facebook, Craigslist, to the extent configured by you within the Reposter. You grant the Company all rights necessary to execute such automated actions solely for the purpose of delivering the Reposter’s functionality.<\/p>\n \n <h3>3.2 User Content Rights.<\/h3>\n <p>You represent and warrant that you own or have all necessary rights to User Content and the authority to post it via the Reposter, and that your postings will not infringe any third-party rights, violate laws, or breach platform rules.<\/p>\n \n <h3>3.3 No Unlawful or Abusive Use.<\/h3>\n <p>You must not use the Reposter for unlawful conduct, spam, scams, harassment, abusive behaviour, or to circumvent platform access controls in ways prohibited by applicable law.<\/p>\n \n <h3>3.4 Rate Limits, CAPTCHAs & Changes.<\/h3>\n <p>Third-Party Platforms may rate limit, throttle, deploy CAPTCHAs, or change their interfaces; the Reposter may fail or behave differently as a result. You understand and accept these risks.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>4. Automated Interactions<\/h2>\n <h3>4.1 Authorised Automation.<\/h3>\n <p>The Reposter performs Automations that you configure. To the maximum extent permitted by law and platform terms, you authorise those Automations on your behalf.<\/p>\n \n <h3>4.2 Human-in-the-Loop.<\/h3>\n <p>You remain responsible for reviewing any drafts or postings before they are sent where the Reposter offers that option.<\/p>\n \n <h3>4.3 Fair Use & Load.<\/h3>\n <p>You agree to configure reasonable schedules and volumes. You must not overload or attempt to degrade a Third-Party Platform.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>5. Credentials & Security<\/h2>\n <h3>5.1 Your Accounts.<\/h3>\n <p>The Reposter interacts with your authenticated browser sessions. By default, we do not require you to provide Third-Party Platform passwords directly to us. If you elect to store or transmit Credentials to us or our services, you authorise us to process them solely to operate the Reposter and as described in our Privacy Policy.<\/p>\n \n <h3>5.2 Safeguards.<\/h3>\n <p>You are solely responsible for safeguarding your Devices, browsers, network, and Credentials (including enabling 2FA where available), and for all activities under your accounts. We are not responsible for any unauthorised access to or compromise of your Third-Party Platform accounts (including, without limitation, Facebook Marketplace accounts), regardless of how such access occurs, and you bear sole responsibility for securing your accounts and login information.<\/p>\n \n <h3>5.3 Security Events.<\/h3>\n <p>You must promptly notify us of any suspected unauthorised access to the Reposter or your accounts. We may require you to implement additional security steps or suspend Automations pending investigation.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>6. Service Changes; No Guarantee of Posting<\/h2>\n <h3>6.1 No Guarantee.<\/h3>\n <p>We do not guarantee that any post, re-post, or other action will be completed, delivered, or remain available. Third-Party Platforms can block, remove, shadowban, throttle, or otherwise interfere with your posts or accounts at any time.<\/p>\n \n <h3>6.2 Updates.<\/h3>\n <p>We may modify, suspend, or discontinue features without notice where required by law, by App Distributors, or due to changes on Third-Party Platforms.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>7. Fees & Trials<\/h2>\n <h3>7.1 Billing.<\/h3>\n <p>If the Reposter is offered on a subscription basis, fees, renewals, and cancellation terms are as stated at the point of purchase or in your account dashboard.<\/p>\n \n <h3>7.2 No Refunds.<\/h3>\n <p>Except where required by law, fees are non-refundable once the billing period begins.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>8. Intellectual Property<\/h2>\n <h3>8.1 Our IP.<\/h3>\n <p>The Reposter, its code, design, and all related IP are owned by us or our licensors.<\/p>\n \n <h3>8.2 Restrictions.<\/h3>\n <p>You must not (except where prohibited restrictions are unenforceable by law): (a) reverse engineer, decompile, or disassemble the Reposter; (b) copy or distribute it; (c) remove proprietary notices; (d) use it to build a competing product; or (e) use any non-public interfaces.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>9. Prohibited Uses (Reposter-Specific)<\/h2>\n <p>You must not use the Reposter to:<\/p>\n <ul>\n <li>engage in illegal scraping where prohibited by law;<\/li>\n <li>send unsolicited or deceptive communications;<\/li>\n <li>deceive, impersonate, or misrepresent identity;<\/li>\n <li>upload malware or attempt to bypass security measures; or<\/li>\n <li>interfere with or degrade Third-Party Platforms.<\/li>\n <\/ul>\n <\/div>\n\n <div class=\"section\">\n <h2>10. Disclaimers<\/h2>\n <h3>10.1 “AS IS”.<\/h3>\n <p>To the maximum extent permitted by law, the Reposter is provided “AS IS” and “AS AVAILABLE” without warranties of any kind (including fitness for a particular purpose, non-infringement, error-free or uninterrupted operation, or data security).<\/p>\n \n <h3>10.2 No Third-Party Liability; Waiver.<\/h3>\n <p>We are not responsible for the acts or omissions of Third-Party Platforms, including account suspensions, removals, shadow-bans, throttling, outages, or policy changes, and you irrevocably waive and release any claims, demands, or causes of action against us arising from or related to such platform actions.<\/p>\n \n <h3>10.3 Australian Consumer Law.<\/h3>\n <p>Nothing in this EULA limits your non-excludable rights under the Australian Consumer Law.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>11. Limitation of Liability<\/h2>\n <h3>11.1 Cap.<\/h3>\n <p>To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Reposter will not exceed:<\/p>\n <ul>\n <li>(a) if you are a paid user, the total amount you have paid to us for the Reposter in the 12 months preceding the event giving rise to liability; or<\/li>\n <li>(b) if you are a free user (including trial users), AUD $0.<\/li>\n <\/ul>\n \n <h3>11.2 Excluded Damages.<\/h3>\n <p>To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data; cost of substitute goods\/services; or business interruption, even if foreseeable.<\/p>\n \n <h3>11.3 Carve-outs.<\/h3>\n <p>The above limitations do not apply to liability that cannot be excluded by law (e.g., death or personal injury caused by negligence).<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>12. Indemnification (User Obligations)<\/h2>\n <p>You will defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:<\/p>\n <ul>\n <li>(a) your User Content or your use of the Reposter;<\/li>\n <li>(b) your breach of this EULA or violation of any law;<\/li>\n <li>(c) your use of Third-Party Platforms, including any alleged or actual non-compliance with their terms, policies, or community standards;<\/li>\n <li>(d) any account action taken by a Third-Party Platform against you (including warnings, limits, suspensions, blocks, or permanent bans), and any consequential loss or damages you suffer as a result;<\/li>\n <li>(e) any security breach of your Device(s), network, browser, or Third-Party Platform account(s), including compromises arising from your storage, transmission, or failure to safeguard Credentials, or from malware or misconfiguration in your environment; and<\/li>\n <li>(f) any claim that your use of the Reposter infringes or misappropriates third-party rights when based on your configuration, prompts, schedules, logged-in automation sessions, or User Content.<\/li>\n <\/ul>\n <p>Your indemnity applies to the maximum extent permitted by law and does not require a prior finding of fault by us. We may assume control of the defence at our expense; you will cooperate fully.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>13. Suspension & Termination<\/h2>\n <p>We may suspend or terminate your access to the Reposter immediately (with or without notice) if you breach this EULA, if required by law or by an App Distributor, or if continued operation would pose risk. Upon termination, you must stop using and uninstall the Reposter. Sections intended to survive (including 3\u20135, 6.1, 8\u201312, 15\u201316) will survive.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>14. Distributor Terms & Third-Party Beneficiaries<\/h2>\n <p>Where applicable, your use of the Reposter is also subject to the terms of the relevant App Distributor (e.g., Chrome Web Store, Apple, Google). Those distributors are third-party beneficiaries of this EULA with the right to enforce applicable provisions.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>15. Export, Sanctions & Compliance<\/h2>\n <p>You represent that you are not located in, under the control of, or a national or resident of any country or person on any applicable sanctions list. You will comply with all export control and sanctions laws applicable to your use of the Reposter.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>16. Governing Law; Venue<\/h2>\n <p>This EULA is governed by the laws of the State of Victoria, Australia, without regard to conflict of laws rules. You submit to the exclusive jurisdiction and venue of the courts located in Victoria, Australia. Nothing limits mandatory protections under applicable consumer law.<\/p>\n <\/div>\n\n <div class=\"section\">\n <h2>17. Changes<\/h2>\n <p>We may update this EULA from time to time. Material changes will be notified via the Reposter, our site, or email. Your continued use after the effective date constitutes acceptance of the changes.<\/p>\n <\/div>\n\n <div class=\"contact-section\">\n <h2>18.
